These Terms govern your access to and use of Magic PTT, a hosted push-to-talk voice, chat, and radio-bridging service operated by DigiDom Advanced Technology.
These Terms of Service (“Terms”) govern your access to and use of Magic PTT (the “Service”), a hosted push-to-talk application provided by DigiDom Advanced Technology (“Magic PTT”, “we”, “us”). The Service lets you talk over the internet, exchange chat and photos, create private rooms, and — on channels that are linked to a radio repeater — transmit over the air. By creating an account, accepting an invite, or otherwise using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to create an account (or older where your local law sets a higher age of digital consent). Transmitting on any channel that is bridged to an amateur (Ham) or GMRS radio repeater additionally requires that you hold a valid, current FCC license of the appropriate class and that you follow all applicable rules — see Section 4. You are responsible for determining whether a license is required for your activity.
2. Accounts and access
Some areas of the Service require an account, and certain networks (including the SHTF Radio Networks talkgroup) require admin approval before you can join. You are responsible for keeping your credentials secure and for all activity that occurs under your account. You agree to provide accurate information, including any callsign you enter, and to keep it up to date. We may decline, suspend, or revoke access at our discretion, including where approval is required for a network.
3. Channels, rooms, and the repeater
The Service includes different kinds of channels:
- Internet-only channels. Anyone with an account may listen and talk; no radio license is required.
- RF / repeater-linked channels. Audio on these channels is bridged to one or more radio repeaters and transmitted over the air. A valid FCC license is required to transmit, and your transmissions are public (see Section 4).
- Private Magic Rooms. Rooms you create and control, where you invite participants by search, email, a Magic Key, or a scannable QR code, and may appoint moderators.
4. Radio transmission & FCC compliance
Channels that are linked to a radio repeater carry your voice onto licensed radio spectrum. You are solely responsible for your transmissions and for complying with all applicable laws and regulations, including the rules of the U.S. Federal Communications Commission (FCC). In particular, when transmitting on a repeater-linked channel you agree that you will:
- Hold and maintain a valid FCC license appropriate to the band and service in use (for example, Part 97 for amateur/Ham or Part 95 for GMRS), and identify your station as required by those rules;
- Not transmit on amateur frequencies for business or commercial purposes, transmit music, use profanity or obscene/indecent content, encrypt communications to obscure their meaning, or broadcast one-way/unattended content except as expressly permitted by the applicable rules;
- Not cause harmful or willful interference, jam, or transmit false or deceptive signals, and yield to emergency communications at all times;
- Follow the operating rules of the network, repeater, or talkgroup you are using, including directions from net control and Magic PTT moderators or admins.
Radio transmissions are public. Anyone with a suitable receiver can hear, and may lawfully record, what you transmit over the air. Do not transmit anything you need to keep private. Magic PTT does not and cannot make over-the-air transmissions confidential.
5. Your content
You retain all rights to the voice, chat messages, photos, room names, and other content you submit (“Your Content”). You grant Magic PTT a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, route, transcode, and otherwise process Your Content solely to operate and provide the Service — including routing live audio between participants, bridging it to repeaters on RF channels, generating live captions and translations where enabled, and sending data to the providers described on our subprocessors page. You are responsible for ensuring you have the rights to share what you submit.
Voice communications in private rooms are ephemeral and are not stored or recorded by us, unless a room owner explicitly enables recording (where that feature is available) and only with all-party consent. If you enable or participate in recording, you are responsible for obtaining any consent required by the laws of every applicable jurisdiction. Remember that transmissions on RF/repeater-linked channels are public and may be lawfully received and recorded by others (see Section 4). 6. Acceptable use
You will not, and will not permit anyone using your account to:
- Use the Service for unlawful purposes, or to transmit unlawful, harassing, threatening, hateful, or fraudulent content;
- Violate the radio-transmission rules in Section 4, cause interference, or transmit on RF channels without the required license;
- Impersonate another person or station, or use a callsign you are not authorized to use;
- Probe, scan, or test the security of the Service, attempt to access accounts, rooms, or data that are not yours, or disrupt the Service;
- Reverse engineer or attempt to extract source code except where applicable law prohibits that restriction;
- Resell, sublicense, or commercially redistribute the Service without our prior written consent.
We may remove content, mute or remove participants, or suspend or terminate accounts that violate these rules, with or without notice depending on severity.
7. Live captions & AI features
On channels where captions are enabled, the Service uses third-party speech-to-text and translation providers to produce live captions. These features may be inaccurate or incomplete and should not be relied on for safety-critical decisions. See our Live Captions & Translation page for the full scope and safeguards.
8. Subscriptions, fees, and trials
Magic PTT is currently provided free of charge while in active development, and free access may change or end at any time. If and when paid plans are introduced, they will be billed in advance in U.S. dollars through our payment processor, and the trial, cancellation, and refund terms described in our refund & cancellation policy will apply. Fees are exclusive of taxes, which are your responsibility.
9. Third-party services
The Service relies on and may link to third-party services (for example our media, database, captioning, translation, and email providers, and repeater/network infrastructure operated by others). Your use of those services is governed by their own terms, and we are not responsible for their content, practices, or availability.
10. Termination
You may stop using the Service or close your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay any fees that become due, transmit unlawfully, or use the Service in a way that harms the platform, the radio networks, or other users. Provisions that by their nature should survive termination (including content licenses you granted for already-transmitted content, disclaimers, limitations of liability, and indemnification) will survive.
11. Service changes and beta features
We continuously improve the Service, and some features are experimental or labeled “beta” and may be changed or removed at any time. We will not materially decrease the functionality of generally-available features without reasonable notice where practicable.
12. Disclaimers
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT AUDIO WILL BE DELIVERED, OR THAT CAPTIONS OR TRANSLATIONS WILL BE ACCURATE. MAGIC PTT IS NOT A SUBSTITUTE FOR A 911 OR OFFICIAL EMERGENCY SERVICE AND MUST NOT BE RELIED ON FOR EMERGENCY COMMUNICATIONS WHERE LIFE OR SAFETY DEPENDS ON DELIVERY.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR USD $100.
14. Indemnification
You will defend, indemnify, and hold harmless DigiDom Advanced Technology from third-party claims arising out of (a) your violation of these Terms, (b) Your Content, (c) your transmissions or use of radio spectrum, or (d) your use of the Service in violation of applicable law or FCC rules.
15. Governing law and disputes
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules. Before filing a formal dispute, you agree to first contact us via the contact page and attempt to resolve the matter informally. Any unresolved disputes will be brought exclusively in the state or federal courts located in [STATE].
16. Changes to these Terms
We may revise these Terms from time to time. The current revision is identified by the version stamp at the top of this page. When a revision is material, signed-in users may be prompted to re-accept and we may notify account holders by email. Continued use of the Service after a revision takes effect constitutes acceptance.
17. Miscellaneous
These Terms, together with the Privacy Policy and other linked policies, are the entire agreement between you and Magic PTT regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our prior written consent. No waiver of any term is a continuing waiver.
